1. Customer Declaration
By signing this contract, you declare that you are over the legal age of 18 years and you are one of the legally registered owners /authorized persons of the property at the installation address and your name is on title deed. All information provided to Sun Solar Australia is true and correct.
As a homeowner/ authorized person, you authorize Sun Solar Australia to lodge an application for Grid connection on your behalf and to do any further communication with Network Distributor or any relevant parties regarding your solar application.
2. Small Technology Certificates (STCs) and Rebates
Government incentives are designed to encourage a switch to Cleaner, Greener, and sustainable Energy Solutions for life. Solar Power Systems attract Renewable Energy Certificates (STC’s).
Solar Power Systems attract STC’s rebates were always paid directly to you the customer by the government, but have been discontinued.
STC’s are either traded on a Spot Market that can go up or down in value from day to day, or are sold via a government legislated Clearing House at the predetermined price.
(a). You have the choice of keeping your STC entitlements and placing them in the Clearing House yourself or offering them to us in exchange for a discount and accepting whatever value they have at the time of installation. This second choice means that, sometimes, your final NET COST may have been higher or lower than on the day of our quote.
(b). By singing STC form you assign all STC’s generated from your solar system to Sun Solar Australia in exchange for a discount that Sun Solar Australia has offered and you are liable to pay your out-of-pocket expense to Sun Solar Australia.
3. System Orientation and Performance
Solar panels require northernly orientation free from shade for optimum performance. Shading particularly affects Solar Power PV Systems, and can significantly reduce the amount of power produced. It is the customer’s responsibility to perform any action any required to remove any shading.
System performance may be different due to many factors such as shading, season, the direction of panels, location, etc. All savings are discussed are based on assumptions only and may vary depending on actual usage and time of use of electricity at your premises.
For a Solar system to work at full capacity it needs a perfect angle and perfect direction to be installed, however, due to different size, type, pitch, and direction of the roof it is always not possible, so Sun Solar Australia will install a system with what is best available at your premises.
4. Roofing Disclaimer
We only refer installs to appropriately licensed and experienced tradespeople. As professionals, they will take every care of your roof. However, accidents can happen. Therefore, we particularly draw your attention to the following:
(a). Decramastic Roofs: Due to the fragile nature of these roofs, we generally recommend against any kind of installation on them. If, however, you choose to proceed, it will be with due care, but at your risk.
(b). Asbestos Roofs: Many installers are unwilling to work with this risk. Therefore, any quote for installation on such a roof is subject to the availability of an installer and it will be at the customer’s risk.
(c). Tiled Roofs: In the unlikely event of breaking a tile, as every house has a different shape, type, and color of the tile, it is the customer’s responsibility to provide replacement tile on the day of installation. So that we can replace any broken or cracked tile.
(d). Tin Roofs: Usually these roofs are easiest and best to deal with, but some time due to very old and rusted roofs any damages that occurred during installation will be at owners’ risk.
(e). Installation on certain types of roof, i.e., Decramastic Roof, Asbestos Roof, Terracotta Tile Roof may incur extra costs for the installation. As a customer you are liable to pay such costs, if you choose to proceed ahead.
5. Confidentiality:
We only disclose your personal information to your Network Provider or relevant parties in order to process the application and to generate STC’s. Because we respect your rights to privacy, we do not sell your information to third parties. We may however contact you in the future regarding other products and services that may be of interest to you. for further information, please refer to our privacy policy.\
6. Warranties
Product Warranty:
All product warranties offered are in accordance with the manufacturer of the product. Sun Solar Australia is offering 5 years retailers’ warranty in addition to consumer guarantees required under Australian Consumer Law. Sun Solar Australia’s retailer’s warranty exists over and above the consumer’s rights under consumer guarantees in ACL.
Workmanship Warranty:
On top of the product warranty from manufacturers, Sun Solar Australia is offering 10 years of workmanship warranty for operation and performance of the whole system to all installations carried out by us or our contractors. During this period Sun Solar Australia will repair any such faults or defects notified to us within the warranty period, including replacing a system or a part of the system required within a reasonable timeframe at no cost to you.
The warranty will not apply if:
(a). The fault or a defect is not notified to us during the warranty period
(b). The system has been repaired, modified, reinstalled, or re-positioned without our written approval
(c). Any change made by anyone who is not by us or our contractors
(d). The system is not being maintained in accordance with the manufacturer’s requirements
(e). If the system has been damaged by extreme weather conditions
7. Payment Terms and Finance
Quotes are valid for a period of seven (7) days.
A deposit of 10% or ($500 minimum) of your total new investment is required. Orders are not accepted until the deposit is received.
The Outstanding Balance is due via Direct Deposit/EFT no later than the day of installation. Sun Solar Australia will retain legal ownership of whatever system(s) are installed until the clear funds for the total amount owing have been received, and reserves the right to enter your property and remove the system(s) in the event of non-payment of any outstanding balance. Any damage done to the system during this period will be the customer’s responsibility.
If you have chosen a finance option and finance is not approved it will be the customer’s responsibility to organize the payment to Sun Solar Australia in a timely manner. If the payment has been delayed Sun Solar Australia reserves a right to charge you the interest at 18% per annum. Failure to pay in full for the solar system may result in Sun Solar Australia taking legal action against the owner and will void all warranties. Any expenses that occurred due to the recovery of debt will be passed on to the customer.
8. Refunds
If you have paid us the money under this agreement but the agreement ends for any of the following reasons before we install the system at your premise, we will return all of your money you have paid:
(a). If we have not delivered and installed the system at your premises within 3 months of your contract signed to date.
(b). If your grid connection approval has been refused by the network distributor
(c). If originally quoted equipment is not available and you refuse to accept any similar types of equipment
Also, as a customer you are entitled to a full refund if the final system design is significantly different to that quoted at the point of contract and is not signed off by you.
9. Premise Access
We assume that you authorize Sun Solar Australia and its workers or contractors to access the property at all reasonable times in order to perform the necessary work to install and connect your Grid-connected PV system.
10. Meter Upgrade
Meter upgrade if required is not a part of your solar job and therefore, Sun Solar Australia is not liable for any type of meter upgrade which may be required as per the network distributor’s metering manual.
we may recommend you suggested upgrade required if any, however, it is the customer’s responsibility to keep their meter box fully compliant as per their area requirements.
Sun Solar Australia quotes do not include any wirework required from PV inverter to meter box if your meter box is located remotely and if the system does not perform due to size or type of cable been used from meter box to the structure where PV system and inverter is installed. Any meter upgrade performed by Sun Solar Australia or any of its workers and contractors will be at the customer’s cost and any charges charged by the network distributor in order to perform this work will be passed on to the customer.
11. Cooling Off Period
Sun Solar Australia acknowledges that under Australian Consumer Law and relevant departments that customer is entitled to a cooling-off period of 10 business days. Sun Solar Australia only accepts cancellation in writing via email or post during the cooling-off period. Emails can be sent to info@sunsolaraustralia.com.au
12. Approvals
Grid Connection Approval
We will apply for Grid Connection Approval on your behalf. In doing this, we will:
(a). Make the application as soon as possible;
(b). Keep you updated on the progress of the application;
(c). Respond, within a reasonable time-frame, to any information or other requests from the distributor; and
(d). Promptly give you notice of the outcome of the application.
Your purchase of the System is subject to Grid Connection Approval being granted.
If Grid Connection Approvals refused, then this agreement will end and we will give you any refund required under clause 8 (b).
13. Delivery and Installation
(a). Sun Solar Australia always uses Clean Energy Council Accredited Installers to installs the PV system in the best interest of the customer to make sure it works to the best of its ability and makes all efforts to install your system in a timely manner. However, it is not always possible as most of the manufacturers are overseas and due to many different reasons’ goods are delayed due to import/Export rules in Australia.
(b). Sun Solar Australia will always try to install your system by/before the target date, however, the target date is just an idea and the install date can be changed due to many different factors like product availability, weather conditions.
(c). Sun Solar Australia confirms that a full refund will be available upon request if the site-specific full system design and performance estimate is provided after signing the agreement is not consented to upon receipt.
(d). Sun Solar Australia prefers that any outstanding balance of your PV system must be clear as soon as the system is installed on a customer’s roofs.
(e). A homeowner / authorized person must inform Sun Solar Australia before the installation starts if they have any preferences about the installation of panels or inverters at a specific location, Installers will try their best to work as per customer’s preferences, however sometimes it becomes non-standard installations due to distances or location of meter box or circuit breakers if the owner still wants to proceed it may cost extra to the owner depending on a situation.
(f). A homeowner must sign all paperwork on the day of the installation that may be required by governing bodies or Sun Solar Australia as per the agreement.
(g). A homeowner must co-operate with installers at all times in regard to access to the property.
(h). A homeowner should be aware that as a part of your solar installation we may have to disconnect you from the grid for some time to ensure the safety of our installers.
(i). Sun Solar Australia confirms that once the customer has signed a contract, any variation in design & install cost will be documented and must be signed by the customer prior to installation. If any extra work arises on-site on the day of installation which has not consented to in the contract, full refunds will be provided.
(j). Sun Solar Australia installers are licensed PV designers and they will try their best that your system installation will be carried as per design which was indicated to you at the time of signing a contract, however due to many different factors like screw line, legal allowance from ridge and gutter, inverter limitation etc., your panel lay out design may be different. If you have any preferences about your panels and inverter location you must inform installers on the day of installation before work has been carried out.
(k). Any panels offered / installed more than the size of your inverters are free panels (if installed) and does not qualify for refund or reimbursement.
(l). For all system Wi-Fi monitoring, it is customers responsibility to provide with strong Wi-Fi signals to the location of inverter.
14. Risk and Liability Acceptance
(a). You understand that Sun Solar Australia accepts no liability or responsibility for your STC incentives as administered by the office of the Clean Energy Regulator.
(b). Once the installation is completed and payment received in full by Sun Solar Australia, we pass the ownership to you and from installation onwards it is the customers’ responsibility to make sure your system is covered in your property insurance.
(c). You understand that Sun Solar Australia accepts no responsibility for your feed-in tariff which can be changed by retailers or any concerning bodies at any time. We Suggest to contact your energy retailer and check your tariff before and after your solar install.
(d). You understand that Sun Solar Australia accepts no responsibilities of any upgrade require of your meter box or any change in meter Gross/net. Any meter upgrade requirement by your energy retailer/distributor must be organized by customer.
(e). You understand that Sun Solar Australia accepts no responsibilities for old and brittle roofs which may be damaged during installations.
(f). Sun Solar Australia takes full responsibility for any work performed by contractors / employees / agents.
(g). Sun Solar Australia will suggest a size of the system as per understanding from your electricity bill and the questions answered by the customer, Sun Solar Australia takes no responsibilities about size or savings recommended to customers by any of our workers or contractors. Savings suggested may change due to different factors like the amount of usage, Time of usage, Bad weather, the performance of your system, etc. We recommend our customers who have net PV meters should use most of their electricity during sunlight hours and reduce your usage during non-sunlight hours in order to get maximum benefits from your solar system.
(h). If ever your solar system fails or stops working, we highly recommend that you contact Sun Solar Australia if you are under warranty or appoint only a Clean Energy Council accredited installer to perform any work on your system. During the period non-performance of the system there will be no compensation paid to customer by manufacturer or Sun Solar Australia.
(i). It is the customer’s responsibility to keep your PV system clean and free from any debris which may have gathered from nearby sites like trees, Construction site, farming site. Not keeping your system and panels clean may result in making your panels faulty and be not covered under your warranty. Sun Solar Australia highly recommend good clean at least once a year to have your system working at full ability.
(j). Sun Solar Australia accepts no responsibilities of acceptance of approval of your size of the system by your Network Distributor. Due to restricted infrastructure of Network Distributor in some areas Network Distributor comes with special conditions, which must be followed in order to proceed with the installation, any expenses, as a result, will be a responsibility of the customer.
(k). Sun Solar Australia always wants to work in a responsible manner & declares that we will comply with the CEC Solar Retailer Code of Conduct.
